What Are Birth Injuries?

Birth injuries refer to physical harm or trauma sustained by a fetus or infanrt, during pregnancy, labor or delivery. We do not pursue claims for minor injuries, such as bruising or minor bleeds –and indeed there are risks of any delivery.  However, when significant injuries such as fetal hypoxia, cerebral palsey or major nerve damage occurs as the result of true medical negligence, we are prepared to evaluate and (when indicated) litigate the matter to obtain fair compensation for our clients. 

What is Medical Malpractice in Birth Injury Cases?

Medical malpractice is, by definition, a “deviation” or “departure” from accepted standards of care. (NY Pattern Jury Instruction 2:150). In birth injury cases, malpractice means when providers fail to adhere to the accepted standard of care during pregnancy, labor or delivery, resulting in harm to the mother or child. Examples of negligence include: 

  • Failure to monitor fetal distress, such as abnormal heart rates or heartbeat indicating oxygen deprivation. 
  • Delayed C-sections, missing critical windows to prevent harm. 
  • Inadequate response to complications, such as umbilical cord entrapment or placental abruption. 
  • Failing to recognize a “set up” for problems: such as placenta previa, or gestational diabetes. 
  • Failing to slow premature labor, or give “surfactant” to minimize problems from premature delivery. 
  • Failing to recognize prenatal infections that can cause blindness or brain damage. 
  • Errors in anesthesia, leading to complications for the mother or infant. 
  • Negligent postnatal/ NICU care.

  • Infections: From inadequate wound care or unsterile conditions post-delivery. 
  • Maternal Hemorrhage: Failure to recognize placental abnromalities or to control bleeding after birth. 
  • Uterine Rupture: A rare but serious complication from mismanaged labor.
